ThousandEyes complies with the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield Frameworks (Privacy Shield) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom and Switzerland to the United States in reliance on Privacy Shield. ThousandEyes is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. ThousandEyes complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, ThousandEyes is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, ThousandEyes may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

1. The Information We Collect and How We Use It
In general, you can use our Site without providing us with any personal information. However, there may be instances where you must provide us with certain personal information in order to receive full access to certain features of the Site or to assist us in delivering a superior level of customer service. In such instances, we may collect the following types of information:
  • Registration Information - When you register with ThousandEyes, you provide us with certain personal information, such as first name, last name, and e-mail address. We may use this information to contact you regarding notifications about the Site or new products and services we make available.
  • Log Files - When you access the Site, our servers automatically record information that your browser sends whenever you visit any website. These log files may include information such as your Internet Protocol address, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyse trends, to administer the Site, to track users' movements around the Site and to gather demographic information about our user base as a whole.
  • Cookies and tracking technologies - Technologies such as: cookies, beacons, tags and scripts are used by ThousandEyes, Inc. and our marketing partners, analytics and service providers delivering chat capabilities. These technologies are used in analysing trends, administering the site, tracking users' movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.   • Local Storage - We use Local Storage (LS) such as HTML5 to store your name and contact information. Third parties with whom we partner to provide certain features on our site or to display advertising based upon your Web browsing activity use LS such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML5 LS.
  • Local Shared Objects - We use Local Shared Objects, such as Flash cookies to store content information and preferences. To manage Flash cookies, please click here.
  • Behavioral Advertising - We partner with a third party to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking the "Consent Manager" link (located on the bottom of every web page).   • Widgets - Our Site includes certain social media features, such as the Facebook "like" button. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features and widgets are governed by the privacy policy of the company providing it.
  • Order Information - If you purchase a product or service from us, we request certain personal information from you on our order form. You must provide contact information (such as name and email) and financial information (such as credit card number and expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.
  • User Communications - When you send email, initiate Chat, register for our webinars, or use other types of communications with us, we may retain those communications in order to process your inquiries, respond to your requests and improve the Site.
  • User Content - If you use a message board or post reviews or comments on the Site (e.g., to our blog), you should be aware that any personal information you submit there can be read, collected, or used by other users of the Site, and could be used to send you unsolicited messages.
